FBI Director Kash Patel shared a photo on X that features Milwaukee County Circuit Judge Hannah Dugan, who was arrested for allegedly obstructing federal immigration officials during her detainment.
The image does not clearly show Dugan’s face; it captures her being led away by three law enforcement officers. Patel’s caption stated, “No one is above the law,” emphasizing accountability.
Per the Confidentiality and Media Contacts Policy outlined on the Justice Department’s website, DOJ personnel are advised against disclosing defendants’ photographs unless necessary for law enforcement or those that are already part of the public record.
Eric Holder, former Attorney General under the Obama administration, noted that during his time, efforts were made to limit media access to defendants’ photos, including mug shots.
Holder commented to CNN that Patel’s recent post breaches this established policy. He stated, “Whatever the issues with what the judge did, they’re trying to maximize intimidation.”
On April 25, Director Patel uploaded the image of Judge Dugan, who was arrested for allegedly assisting an undocumented person evade apprehension. Sections of the image were obscured in the original share.
There is uncertainty regarding whether current Attorney General Pam Bondi has revised the policy concerning the release of defendant photographs.
Craig Mastantuono, Dugan’s attorney, criticized the FBI’s actions, stating in a CNN interview, “The arrest is the point. It’s a clear departure from the policy. There was no threat to public safety. She was not given the opportunity to present her side.”
Dugan faces two charges related to obstruction and concealing a person from arrest. She appeared in court shortly after her arrest and was subsequently released.
The FBI has yet to comment on Director Patel’s social media post.
