In a notable development for advocates of literary freedom, the Matanuska-Susitna Borough School District in Alaska has agreed to a settlement of $89,000 following claims that the district unlawfully removed numerous books from its school libraries. This decision follows a favorable ruling earlier in August, marking a significant step forward for supporters of the right to read.

Savannah Fletcher, an attorney representing the Northern Justice Project, emphasized the implications of this case: “The court’s ruling, along with this settlement, validates what students and their families have expressed—that books cannot be simply expunged from libraries due to the intolerance of a vocal minority,” she stated in a recent statement. She highlighted the Constitution’s protection of free speech and the dissemination of ideas, expressing hope that the district would refrain from making hasty judgments about literature.

The legal action initially commenced nearly a year ago, on November 17, 2023, with the American Civil Liberties Union (ACLU) of Alaska and the Northern Justice Project filing suit against the Mat-Su school district, situated north of Anchorage. The plaintiffs sought the reinstatement of 56 books that had been removed following complaints from a few parents, pending the establishment of a review committee. Notable works taken from the libraries included critically acclaimed titles like Toni Morrison’s The Bluest Eye, Margaret Atwood’s The Handmaid’s Tale, and Kurt Vonnegut’s Slaughterhouse-Five, as well as a number of books addressing themes related to race, sexuality, and adolescent health.

During hearings, district officials argued they possessed broad authority to assess library holdings. However, the plaintiffs contended that the books were removed in the absence of due process, solely based on limited complaints, before any review committee could be organized. In a decisive ruling on August 6, federal judge Sharon Gleason sided with the plaintiffs, ordering the return of most of the challenged titles to library shelves, citing the potential risks of “official suppression of ideas.”

Despite the settlement, school officials maintained that no wrongdoing occurred, asserting that a review committee had since approved the majority of the titles for reinstatement—revealing an apparent acknowledgment that the books should have remained accessible to students. The district explained that its choice to settle was aimed at avoiding the costs associated with a prolonged trial. They expressed confidence in their approach, claiming that the committee had thoroughly evaluated the literature in question. “We are relieved to have this lawsuit resolved and to move on,” said a district representative, as reported by local news sources.

Ruth Botstein, the legal director for the ACLU of Alaska, described the settlement as a crucial reminder of the severe consequences of unconstitutional censorship. She warned that this outcome should signal to other school districts contemplating similar book bans the potential legal repercussions they might face.

This settlement is part of a broader trend of judicial victories for those advocating for the freedom to read. It arises amidst ongoing legal challenges around book banning in various states, including significant cases currently reviewed by the Fifth Circuit U.S. Court of Appeals regarding public library book removals and similar disputes in Iowa and Florida over newly enacted laws aimed at restricting access to certain literature.
