Central Islip, N.Y.: Disgraced former Congressman George Santos was sentenced on April 25 to a maximum of 87 months in prison after pleading guilty to wire fraud and aggravated identity theft. Originally indicted in May 2023, Santos faced multiple charges, including seven counts of wire fraud, three counts of money laundering, one count of public funds theft, and two counts of making false statements to the House of Representatives.

Santos was found to have submitted falsified reports to the Federal Election Commission to secure funds from a national party committee, engaged in identity theft and credit card fraud by misusing contributors’ credit cards, and created a limited liability company under the guise of supporting his campaign while diverting many of the contributed funds for personal use. Additionally, he fraudulently collected unemployment benefits while employed and submitted false financial disclosures to the House of Representatives.

In a notable case from 2022, Elizabeth Holmes was convicted of both conspiracy and wire fraud for misleading investors in the blood-testing startup Theranos. The convoluted nature of her actions made it difficult to classify her conduct under other categories of white-collar crime. However, wire fraud served as a practical means to convey the essence of the deceit involved.

As established in the Supreme Court case of Hammerschmidt v. US, fraud is fundamentally defined as the deprivation of something of value through “trick, deceit, chicane or overreaching.” The application of wire fraud can be broad, requiring only that a falsehood designed to deceive someone for gain was executed via communication means such as phones or computers.

Judge Jed Rakoff expressed the value of mail fraud in white-collar prosecutions, likening it to essential tools for legal practitioners. This perspective also applies to wire fraud, which emerged as a successor to mail fraud, allowing prosecutors to convey their cases more simply and effectively to juries, thereby minimizing potential confusion that could lead to acquittals.

By pleading guilty to key charges of wire fraud and aggravated identity theft, Santos sidestepped the risk of facing a much longer sentence that could have resulted from a jury trial on the broader set of charges against him. This move also allowed prosecutors to avoid the complexities associated with white-collar crime cases, where jury confusion could become a significant factor in the outcome.
