A federal appeals court ruled on Thursday against the Trump administration’s effort to evade accountability regarding the case of Kilmar Abrego Garcia, a Maryland resident who was mistakenly deported to El Salvador last month.

The 4th U.S. Circuit Court of Appeals unanimously rejected a motion to halt a lower court’s order directed at the Trump administration. This order, issued by District Judge Paula Xinis, mandated that the administration provide sworn testimony to clarify whether it complied with her directives to assist in facilitating Abrego Garcia’s return to the United States.
In their filing, the panel stated that the court “shall not micromanage the efforts of a fine district judge attempting to implement” a Supreme Court ruling that requires the government to take action for Abrego Garcia’s repatriation.
The judges went further to describe the administration’s position as “asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order.” They also criticized the argument presented by the Trump administration claiming it was unable to bring back Abrego Garcia due to his detention by a foreign sovereign government.
