Democrats File Lawsuit Against Trump Over Bid for Control of Election Commission

U.S. President Donald Trump is facing legal action from the Democratic Party, as a lawsuit was filed on Friday that accuses him of overstepping his authority with an executive order that allegedly violates federal election law. The Democratic Party claims that this order gives Trump excessive control over the independent Federal Election Commission (FEC).

This lawsuit, lodged in a federal court in Washington, D.C., represents the first instance of the Democratic Party taking legal action against Trump in the context of his second term as President. It has emerged during a time when Democrats, who hold a minority in Congress, are grappling with attempts to counteract significant changes initiated by Trump in the early weeks of his administration, particularly efforts aimed at reducing government oversight and stifling internal dissent.

The legal challenges against Trump’s policies have been numerous since his inauguration on January 20, indicating heightened scrutiny and opposition from various factions.

The crux of the lawsuit pertains to an executive order issued by Trump on February 18 that allegedly grants the White House increased authority over the FEC, as well as other independent agencies like the National Labor Relations Board and the Securities and Exchange Commission, which traditionally operate with a level of autonomy from presidential influence.

Critics have denounced this move as an extraordinary and unacceptable consolidation of power. The Democratic Party argues that the enforcement of this order would permit Trump to impose his viewpoints on election-related controversies, effectively undermining the bipartisan nature of the election commission and allowing him to determine electoral outcomes.

Additional named defendants include Attorney General Pam Bondi, the FEC, and three of its commissioners. In response, a spokesperson for the U.S. Department of Justice stated the department is committed to defending Trump’s agenda vigorously in court. Meanwhile, the FEC has refrained from commenting on ongoing litigation.

Concerns Over Partisan Influence

The FEC was established in 1974 as a response to the Watergate scandal, created to oversee the electoral process and enforce campaign finance regulations. The Democratic Party’s complaint highlights past remarks by Republican President Gerald Ford, who acknowledged bipartisan support for the commission, emphasizing its role in facilitating fair competition between political parties.

However, the plaintiffs argue that allowing Trump to exert detailed control over the commission could compromise its mandate. They contend this level of oversight could enable a “single partisan political figure” to manipulate campaign regulations and adjudicate disputes favorably for his political allies.

Trump’s executive order, titled “Ensuring Accountability for All Agencies,” designates his own legal opinions and those of Bondi as authoritative for federal employees. It further restricts executive branch personnel from promoting alternative viewpoints.

The plaintiffs in the suit consist of the Democratic National Committee, the Democratic Senatorial Campaign Committee, and the Democratic Congressional Campaign Committee. They assert that the implications of Trump’s order are already inflicting significant and irreparable damage, making it more challenging for the Senate committee to respond to a complaint raised by the 2024 reelection campaign of Republican Senator Ted Cruz of Texas regarding his opponent’s campaign advertisements.

The lawsuit aims to affirm the constitutionality of federal laws designed to protect the FEC from “presidential coercion and control,” along with a request to invalidate Trump’s February 18 executive order.
