Education Department Revokes Biden Memo That Could Have Disrupted College NIL Payments

The U.S. Education Department has announced the elimination of a policy established during the final days of the Biden administration. This policy aimed to regulate college athletes’ compensation related to their name, image, and likeness (NIL) rights under federal Title IX provisions.

The Trump administration’s education officials cited the lack of legal grounding for the Biden policy as a driving factor behind their decision. Title IX is a landmark law enacted in 1972 that prohibits sex-based discrimination in educational programs.

According to Craig Trainor, acting assistant secretary for civil rights, the previous guidance was excessively burdensome and unjust, asserting that it exceeded the intended scope of agency guidance.

In a memo dated January 16, the Biden administration had informed universities that NIL payments ought to be regarded similarly to traditional athletic financial aid, such as scholarships.

Institutions have indicated that the majority of NIL revenues are expected to benefit male athletes, particularly those in football and men’s basketball. This expectation raises concerns about compliance with the now-repealed Biden policy, which mandated that NIL payments be equitably distributed between male and female athletes.

Trump administration officials argued that significant policy changes would necessitate explicit legal authority, which they claimed was nonexistent. Trainor noted that Title IX does not provide specific directives on how compensation should be distributed among athletes in monetizing sports programs.
