Glenn Kirschner, a former federal prosecutor and analyst for MSNBC, has asserted that President Donald Trump and his administration could face charges of criminal contempt due to their refusal to comply with U.S. District Judge James E. Boasberg’s orders concerning deportations.
Recently, Trump invoked a historic 18th-century act to authorize the deportation of numerous immigrants to a facility in El Salvador, deliberately ignoring a direct order from Judge Boasberg. Following this, Trump has made calls for the impeachment of the judge, whom he has labeled a “Democrat activist.”
During an appearance on “The Dean Obeidallah Show” on Thursday, Kirschner analyzed the implications of these actions.
“Having spent thirty years as a prosecutor, I can tell you it’s inappropriate to assert in court, ‘Judge, we don’t think the information you’re seeking is relevant.’ That decision belongs to the judge,” Kirschner stated. “It’s only a matter of time before we hear the term contempt, likely starting with civil contempt that could escalate to criminal contempt.”
In a response to the judge’s previous orders, the administration issued a court filing asserting the need to be “more respectful,” which led the federal judge to extend a deadline, allowing the administration 24 more hours to clarify their noncompliance with his initial order.
The Justice Department has described Boasberg’s request for details regarding the deportations as a trivial matter, dismissing it as “a picayune dispute” rather than acknowledging a serious violation of a judicial order.
“In my experience, I can’t recall any lawyers suggesting to judges that they were misinformed in writing,” Obeidallah commented to Kirschner. “This is undoubtedly linked to [U.S. Attorney General] Pam Bondi acting on behalf of Trump.”
On Friday, Trump claimed that he “didn’t sign” the document that triggered the deportations, suggesting that “other people handled” the matter despite his signature being clearly visible at the bottom of the document.
This statement follows a controversial claim made by Trump that his successor, former President Joe Biden, had used an autopen for pardons, which he argued should now be considered invalid.
Kirschner anticipates escalating challenges for Trump moving forward. “There’s a notable fact for viewers: a judge has the authority to appoint an independent prosecutor to handle cases involving contempt of court for failing to respect court orders. It’s going to get a lot more intense from here,” he warned.
