Senator Hawley Proposes Legislation to Eliminate Nationwide Injunctions
Senator Josh Hawley, a Republican from Missouri and member of the Senate Judiciary Committee, has introduced a new legislative measure aimed at curbing the power of federal judges to issue nationwide injunctions, which he claims provoke national crises.
During a recent interview, Hawley articulated his stance, stating, “I believe these judges lack the constitutional authority to impose nationwide injunctions. This legislation is designed to ensure they cannot proceed with such actions.” This initiative follows a pattern of widespread injunctions from federal district judges that have interrupted actions taken by the administration of former President Donald Trump.
The Surge of Nationwide Injunctions
Hawley’s proposal emerges from a significant increase in the number of nationwide injunctions issued against Trump compared to those faced by previous administrations. Since the beginning of his term, Trump has been subject to approximately 15 injunctions, surpassing the total encountered by former Presidents George W. Bush, Barack Obama, and Joe Biden during their full terms.
Responses from Senate Leadership
Senator Hawley has reached out to Senate Republican leadership, urging them to consider his bill. Nonetheless, Senate Majority Leader John Thune of South Dakota has not signaled any intent to advance the legislation. When approached for comment, Thune’s office remained silent on the matter. Earlier this week, Thune acknowledged that Judiciary Committee Chairman Chuck Grassley is reviewing the issue and expressed confidence in the existing judicial appeals process to resolve such matters.
The Political Landscape
Hawley is advocating for the bill to be debated on the Senate floor, even if it faces challenges due to the Senate’s filibuster rules, which require a 60-vote majority to pass most legislation. He expressed curiosity about the shift in perspective among some Democratic senators who previously condemned the use of nationwide injunctions during Trump’s presidency.
Furthermore, Hawley speculates that Trump will back his proposal, highlighting the former president’s prior calls to eliminate these injunctions. In a recent statement on Truth Social, Trump warned that “Unlawful Nationwide Injunctions by Radical Left Judges could very well lead to the destruction of our Country!” He urged, “STOP NATIONWIDE INJUNCTIONS NOW, BEFORE IT IS TOO LATE.”
Hawley has been vocal about his view that the judges issuing these injunctions are ideologically driven opponents of Trump. He criticized them as “liberal judges who fancy themselves part of the resistance” and are prepared to take drastic measures against Trump’s agenda.
