Florida Law Enforcement Arrests Alleged Gang Member Under Alien Enemies Act

The Florida Highway Patrol (FHP) and U.S. Immigration and Customs Enforcement (ICE) announced the arrest of a suspected member of the Tren de Aragua (TdA) gang from Venezuela on Friday. This arrest marks a significant development as Franklin Jose Jimenez-Bracho is the first individual apprehended under the Alien Enemies Act, a legal measure recently invoked by President Donald Trump.

ICE Director Todd Lyons emphasized the threat posed by the TdA, labeling it as a “dangerous foreign terrorist organization” that has established a presence within the United States. “TdA has infiltrated the U.S. from both the northern and southern borders, as well as through our waterways,” he stated during a news conference alongside FHP officials.

Lyons further detailed the criminal activities associated with the gang, citing them as perpetrators of severe crimes including homicide, sexual assault, theft, drug trafficking, weapon smuggling, and human trafficking. “They have been operating freely within our communities, committing the most egregious offenses,” he remarked.

Background on the Alien Enemies Act

The invocation of the Alien Enemies Act is particularly notable, as it allows for the deportation of individuals identified as members of enemy nations without a legal hearing. Historically, this act has been utilized during times of conflict, including the War of 1812, World War I, and World War II. Although it is seldom applied, Trump’s recent move signals a renewed determination to combat threats posed by foreign entities.

In the wake of Jimenez-Bracho’s detention, Lyons revealed that ICE and various local and federal partners had arrested more than 68 suspected gang members and terrorists within the previous two days. “Our commitment is clear: to eliminate the presence of TdA within the U.S. and to safeguard our communities from the risks they present,” he added.

According to officials, Jimenez-Bracho has a documented history as a human trafficker and smuggler, and he remains a target of an ongoing investigation. The operation leading to his arrest involved coordination between the Florida Department of Law Enforcement (FDLE) and FHP, successfully guiding the suspect into the custody of law enforcement.

Reactions and Implications

Florida Governor Ron DeSantis commended the efforts of state law enforcement, asserting Florida’s leadership in combating gang violence. “Once again, Florida leads the way,” he noted on social media. The implications of this arrest and the enforcement of the Alien Enemies Act could signal a shift in how federal and state agencies approach immigration and criminal activity linked to foreign gangs.
