Analysis of ICE Detainer Requests and Sanctuary Jurisdictions

Recent records from the U.S. Immigration and Customs Enforcement (ICE) reveal that over 25,000 detainer requests were not honored by various sanctuary jurisdictions across the nation in recent years. This trend has resulted in the release of numerous individuals who were illegally residing in the U.S. and had been convicted of serious crimes, including homicide.

According to data released to the Center for Immigration Studies (CIS), a total of 72 individuals with homicide convictions or pending charges were set free from U.S. correctional facilities despite having active ICE detainers between October 1, 2022, and February 6, 2025. This situation highlights ongoing tensions surrounding immigration enforcement within sanctuary cities and states.

A significant portion of these releases originated from three detention centers: the Illinois River Corrections Center, the Santa Clara County jail, and the Stateville Correctional Center. Specifically, Santa Clara County jails accounted for six releases, while the Stateville Correctional Center had five individuals released.

The issue of sanctuary jurisdictions—areas that actively limit or prohibit local cooperation with federal immigration authorities—has gained national attention. Former President Donald Trump has renewed his commitment to stringent immigration policies, which includes the promise of mass deportations. His recent comments have suggested potential federal repercussions against sanctuary areas, including the withholding of federal funding.

In a post on Truth Social, Trump stated, “No more Sanctuary Cities! They protect the Criminals, not the Victims. They are disgracing our Country, and are being mocked all over the World. Working on papers to withhold all Federal Funding for any City or State that allows these Death Traps to exist!!!”

Data from ICE indicates that California, recognized as a sanctuary state, accounted for more than half (52%) of the declined detainer requests. Other states like Illinois, Virginia, Massachusetts, and Connecticut also featured prominently among jurisdictions with high numbers of declined ICE requests. While Illinois, Massachusetts, and Connecticut are designated as sanctuary states, Virginia lacks a statewide policy but contains multiple jurisdictions that operate under similar principles.

Alfonso Aguilar, director of Hispanic engagement at the American Principles Project, expressed outrage at the statistics, stating, “It’s shocking that over half of the declined detainers were refused by jails and prisons in California. Gov. [Gavin] Newsom and mayors in the state have a lot of explaining to do to their constituents.”

Despite requests for comments, Newsom’s office has not provided a response regarding the issue. The Santa Clara County jail, the most significant contributor to the number of declined detainers, released nearly 3,000 individuals identified as criminal aliens during the reporting period.

Other notable facilities like Cook County Jail in Illinois and the Fairfax County Adult Detention Center in Virginia also played roles in the release of individuals with criminal backgrounds, with both jails having declined over 1,000 ICE detainers during the same timeframe.

Aguilar went on to criticize the actions of these jurisdictions, saying, “What’s happening in these jurisdictions is unconscionable. Their leaders evidently don’t believe that illegal immigrants that have been charged or convicted with crimes should be removed from their communities. And by ignoring ICE detainers and releasing them into the community, they’re putting in danger the lives and property of their citizens.”

This clash between federal immigration enforcement and local sanctuary policies has sparked significant debate across the U.S. As communities grapple with the complexities of immigration and public safety, the released ICE detainer data may further fuel discussions on the efficacy and ethical implications of sanctuary city practices.

The intersections of law enforcement, community safety, and immigration policy will likely remain contentious topics as local jurisdictions navigate the fine line between protecting residents and adhering to federal immigration laws.
