Lawsuit Claims American Airlines Flight Crew Delayed Assistance for Sick Passenger Until Other Passengers Exited Plane, Resulting in Death

The family of a man who passed away after an American Airlines flight is taking legal action, contending that medical assistance was denied during a critical health crisis, as detailed in a lawsuit.

John William Cannon, aged 62, died on April 29, 2023. The lawsuit, reviewed by PEOPLE, states that his son, Kyle Cannon, believes that appropriate measures could have been taken to avert his father’s death.

In response, American Airlines has indicated to PEOPLE that they are currently “reviewing the complaint.”

According to the wrongful death claims, Cannon boarded American Airlines Flight 1444 at approximately 12:30 p.m. on April 28, 2023, at Louisville International Airport, heading to Dallas.

Cannon was traveling to attend a memorial service for his deceased partner, as his attorney Joseph LoRusso informed McClatchy News on April 24.

The lawsuit states that Cannon experienced a “syncopal event” as he was deboarding from his initial flight. He was helped to the ground of the jet bridge but was allowed to continue on to his connecting flight to Colorado shortly after.

“Despite Mr. Cannon showing significant signs of distress, American Airlines personnel decided to move him from AAL1444 to his next flight, AAL4896 (operated by Envoy Air, Inc.),” the complaint highlights.

The lawsuit alleges that Cannon subsequently became unresponsive, and the flight crew of AAL4896 allegedly postponed requesting medical help until after the plane had landed, taxied, and all passengers disembarked.

He exhibited symptoms such as fluctuating consciousness and troubled breathing during this critical period.

Firefighters from Durango La Plata responded, providing oxygen before transporting Cannon to Mercy Medical Center. Unfortunately, he encountered serious complications during transit, described in the lawsuit as “suffering sinus bradycardia, which escalated to ventricular fibrillation arrest.”

He was pronounced dead in the early hours of the following day.

Kyle Cannon and his legal team claim that the circumstances surrounding his father’s death directly resulted from the negligence of American Airlines and its staff.

“This case exemplifies a troubling corporate mindset at American Airlines that favors inaction rather than proactive measures,” noted LoRusso and Jessica McBryant, representing the Cannon family, in their statement to PEOPLE.

LoRusso and McBryant emphasized that this deep-seated issue, which led to John Cannon’s tragic fate, is something the family is determined to confront, seeking justice for their loved one and advocating for necessary changes within the organization.

Kyle is pursuing damages exceeding $75,000 for “conscious pain, suffering, mental anguish, loss of time and income, medical expenses, and other related damages” incurred before his father’s death, along with attorney fees.
