In the United States, the ability to take a paid sick day remains uncertain for many employees. Unlike several developed nations, the U.S. lacks a federal mandate requiring employers to provide paid sick leave or any form of family and medical leave.
As a result, American workers often navigate a complex landscape of state-specific laws or depend on their employers’ discretion for sick leave. Shockingly, a recent survey conducted in 2023 found that around half of U.S. workers are unaware of their rights regarding paid sick leave as determined by local and state regulations, according to a study sponsored by Theraflu and completed by Wakefield Research.
Reshma Saujani, the founder and CEO of Moms First, which promotes economic empowerment for women and advocates for supportive legislation, is working on addressing this issue. In addition to her leadership at Moms First, she is also known for founding Girls Who Code, an organization dedicated to closing the gender gap in the technology sector.
In 2023, she introduced PaidLeave.ai, an innovative AI chatbot designed to assist parents and caregivers in navigating their state’s paid family leave options. This platform allows users to ask questions tailored to their specific situations and access relevant benefits.
Saujani highlights a troubling trend: even in states that provide paid family leave, participation rates are alarmingly low. Data from New America reveals that only about 3% to 7% of eligible workers utilize these benefits each year. She emphasizes that the complexity of the application process and extensive paperwork can dissuade employees from even attempting to take advantage of available benefits.
This creates a dangerous cycle where underutilization can lead to cuts in benefits. According to Saujani, this illustrates why understanding and effectively employing generative AI solutions is crucial for improving access to paid leave.
Collaborating with Theraflu and A Better Balance, a nonprofit focused on legal advocacy for working families, Saujani’s recent efforts aim to enhance awareness among workers regarding their rights associated with paid sick leave.
“Many individuals are unaware of their entitlements,” Saujani states. “They question whether their state offers paid leave or if their employer provides these benefits. It is vital that workers understand their rights and whether they have access to paid sick time.”
The “Right to Rest and Recover” initiative features educational resources and a confidential legal helpline designed to help individuals comprehend their paid leave options. Those lacking access to paid leave through their jobs may also apply for $200 microgrants to help cover a day without pay.
Saujani also acknowledges that there is a social stigma surrounding the use of paid time off, contributing to the underutilization of these benefits. Drawing from her experiences in high-pressure environments like finance and law, she recounted how the expectation of coming to work even when unwell was commonplace. This detrimental behavior was highlighted during COVID-19, which prompted a cultural shift emphasizing the importance of staying home when ill.
However, Saujani notes a reversion to older attitudes as workplaces transition back to in-person settings. “As we return to the office, the mentality of hustle culture is returning, leading to increased sickness among workers,” she reflectively observes, emphasizing the need for a cultural shift that encourages employees to prioritize their health.
