Elon Musk Moves to Dismiss Class-Action Lawsuit Over Election Giveaway
Elon Musk has petitioned a federal court to dismiss a class-action lawsuit that accuses him of conducting an unlawful lottery related to his $1 million-a-day election giveaway aimed at promoting the U.S. Constitution.
The lawsuit, initiated on November 5, 2024, by Jacqueline McAferty from Arizona, asserts that Musk, who serves as the CEO of Tesla Inc, and his political action committee, America PAC, misrepresented the selection process by implying that winners would be randomly chosen.
In response to the allegations, Musk contended that participants were fully informed that by signing the petition, they were entering a scenario to earn funding as representatives of America PAC rather than through a random lottery mechanism. He further argued that the sharing of personal information by the participants did not result in any harm, countering the claims made in the lawsuit.
The legal action aims to recover $5 million in damages for individuals who signed the petition, alleging that the giveaway was misleading and in violation of Texas state regulations.
Musk’s initiative, which aligns with his backing of Donald Trump’s 2024 presidential bid, involved awarding daily prizes of $1 million to voters in pivotal states who supported the U.S. Constitution by signing the petition. The crux of the legal challenge revolves around whether this promotional scheme constitutes an illegal inducement or is a valid marketing effort.
