Sheriff’s Deputy Cleared in Fatal Shooting of Two Teenagers in New York
In a significant development, New York Attorney General Letitia James announced that no criminal charges will be filed against a sheriff’s deputy involved in the fatal shooting of two Black teenagers in 2023. This announcement was made public on Friday, following a comprehensive investigation by James’ office.
The report concluded that there was insufficient evidence to disprove the deputy’s assertion that he believed his life was in danger when he fired his weapon. Deputy John Rosello of the Onondaga County Sheriff’s Office shot and killed Dhal Apet, 17, and Lueth Mo, 15, while responding to a report of suspicious activity related to the burglary of a smoke shop in Syracuse.
According to the investigation, Rosello was involved when he observed individuals transferring items between two vehicles. The situation escalated when Rosello attempted to use his SUV to block one of the cars, pushing it into a bushy area. Surveillance footage released by the attorney general’s office shows Rosello standing in front of the car as it approached, at which point he drew his firearm.
As the vehicle moved forward, the deputy aimed his weapon, and while it remains unclear precisely when he began shooting—since the video lacked audio and was recorded from a distance—he reported via radio that a “white car [tried] to run me over” before discharging his weapon.
After the incident, Apet and Mo were discovered slumped inside a vehicle over a mile away from the shooting site. While Apet was pronounced dead at the location, Mo succumbed to his injuries later that day in a hospital.
The family attorney representing Apet and Mo chose not to make any comments regarding the findings of the investigation.
