Starbucks Ordered to Pay $50 Million Over Hot Drink Incident

Coffee giant Starbucks has been mandated by a California court to compensate a customer with $50 million after a hot beverage spilled on him, leading to significant burns.

Michael Garcia, the affected customer, underwent multiple medical procedures, including skin grafts, following the incident that occurred at a drive-through on February 8, 2020.

In the courtroom, Garcia’s legal team convincingly argued that a barista neglected to secure one of the large drinks in the takeout tray. When Garcia accepted the tray, the unsecured drink tipped over, resulting in severe burns that led to lasting injuries. According to his attorney, the incident has caused permanent and life-altering disfigurements.

The jury concluded that Starbucks was negligent in its duty of care towards customers. They awarded the substantial payout, reflecting their view of the company’s responsibility in the situation. “This jury verdict is a critical step in holding Starbucks accountable for flagrant disregard for customer safety and failure to accept responsibility,” attorney Nick Rowley expressed in a statement to the Associated Press.

Interestingly, three jurors dissented on the final amount, believing that Garcia deserved a $125 million payout, according to attorney Nicholas Rowley as reported by the Daily Journal.

In response to the ruling, Starbucks announced its intention to file an appeal. The Seattle-based company contended that Garcia himself did not exercise adequate care, suggesting that his actions played a part in the unfortunate event that took place at their West Jefferson Blvd location.

Starbucks maintains that it adheres to “the highest safety standards” when it comes to handling hot drinks. The company also indicated that it had made two settlement offers prior to the trial—$3 million and later $30 million—which were declined. Garcia had reportedly agreed to settle only if Starbucks provided an apology and revised its safety procedures, requests the company ultimately rejected.

Starbucks’s commitment to safety continues to be a focal point in light of this case as the company prepares to appeal the verdict exemplifying the ongoing challenges the food service industry faces regarding customer safety and product handling.
