James Boasberg, the incoming chief judge of the U.S. District Court in Washington, D.C., is at the center of a controversy involving immigration policy and federal judicial authority. On Tuesday, former President Donald Trump called for Boasberg’s impeachment following the judge’s recent rulings that halted Trump’s initiative to deport suspected members of a Venezuelan gang.

Trump’s call for impeachment was made just a day after the Department of Justice sought to have Boasberg recused from the case and asked him to vacate his orders regarding deportations in the District Court. The dispute arose from Boasberg’s issuance of two orders that barred the deportation of individuals claimed to be affiliated with the Tren de Aragua gang, which is categorized as a foreign terrorist organization by the U.S. government.

Trump took to Truth Social to voice his criticism of the judge, describing Boasberg as a “Radical Left Lunatic” who was appointed by former President Barack Obama. He emphasized his belief that Boasberg, not being elected by the public, should not wield the judicial power to contest presidential decisions. Trump asserted that his stance against illegal immigration was a major reason he won the presidency, claiming that judges opposing this agenda, like Boasberg, should be removed from their positions.

The legal challenge against the deportations is spearheaded by the American Civil Liberties Union and Democracy Forward, arguing that the administration’s actions, justified under the wartime Alien Enemies Act, raise significant questions about the criteria used to identify gang members targeted for deportation.

In the latest development, the Justice Department’s court filing claimed that Boasberg “lacks jurisdiction” over the presidential actions in question, stating that these actions should not be analyzed through judicial review. This assertion came after a DOJ lawyer refrained from answering Boasberg’s inquiries during a court hearing, citing concerns over national security.

Boasberg has required the DOJ to provide responses regarding its operations related to the deportations by Tuesday afternoon, particularly inquiring whether any deportation flights had occurred after his injunction was issued.
