Title IX Violation Claims: Maine Under Scrutiny for Transgender Athlete Policies
On Monday, the Department of Health and Human Services (HHS) under President Donald Trump announced that the Maine Department of Education, the Maine Principals’ Association (MPA), and Greely High School are implicated in violations of Title IX. The allegations center on non-compliance with an executive order aimed at excluding transgender athletes from competing in girls’ sports.
In response to the HHS announcement, the MPA released a statement clarifying its position on Tuesday. The association contended that its policy reflects the mandates of the Maine Human Rights Act, which permits athletes to participate in teams aligned with their gender identity, thus adhering to state law.

The MPA emphasized that for Title IX jurisdiction to apply to them, it must first establish that the MPA is subject to its regulations due to receiving federal funding. The MPA highlighted that most of its financing comes from local sources, such as property taxes, along with revenue generated from ticket sales and sponsorships, rather than federal assistance.
The HHS has given the state of Maine a 10-day window to address the findings through a signed agreement, failing which the matter may be escalated to the U.S. Department of Justice for further action. The MPA has expressed anticipation for discussion on this topic within the Maine legislature.
“MPA welcomes an extensive discussion in the Maine legislature regarding the future of this policy. We encourage all stakeholders to express their views thoughtfully and respectfully during public hearings on related bills,” the association noted in its response.

On February 25, HHS issued its notice of violation, asserting that Maine’s policies allowed transgender athletes to unfairly compete in girls’ sports. Subsequently, the investigation was extended to include the MPA and Greely High School.
The discourse surrounding this subject has intensified in Maine, particularly after an incident highlighted by state representative Laurel Libby, where a biological male secured victory in a girls’ pole vault contest at Greely High earlier this year.
During a meeting of Republican governors on February 20, Trump threatened to reduce federal funding to Maine due to its non-compliance with his directive. In response, Governor Janet Mills indicated potential legal action against the Trump administration should federal funding be withheld.
